The Process Server (TPS) The Legal Framework: Laws & Regulations Governing Process Servers

Process servers operate under strict legal guidelines to ensure that legal documents are properly delivered, upholding due process. Every jurisdiction has its own rules, and failure to comply can lead to legal penalties, invalidated service, or even criminal charges.

So, what laws and regulations govern process servers? Let’s break it down.

1. Federal Rules Governing Process Servers

At the federal level, process serving is regulated by the Federal Rules of Civil Procedure (FRCP).

Key Federal Regulations

  • Rule 4 of the FRCP – Defines who can serve legal documents and how service must be completed.
  • Service on Individuals & Businesses – Establishes rules for different types of defendants.
  • Timeframe for Service – Federal cases require service within 90 days of filing the complaint.

Example:

A process server handling a federal lawsuit must serve the defendant within 90 days or risk the case being dismissed.

Important: Federal rules apply only to federal cases—state laws govern state-level process serving.

2. State-Specific Process Serving Laws

Every state has unique regulations for process servers, including licensing, certification, and approved service methods.

States That Require Licensing or Registration

  • Arizona – Process servers must pass an exam and register with the Superior Court.
  • California – Anyone completing more than 10 serves per year must register and post a bond.
  • Nevada – Requires state licensing and fingerprint-based background checks.
  • Texas – Process servers must complete an approved training course and register with the Judicial Branch Certification Commission (JBCC).

States With Minimal or No Licensing Requirements

  • New York (Outside NYC) – No statewide licensing (NYC requires a license).
  • Illinois – No certification required in most counties.
  • North Carolina, Kentucky, Iowa, Maryland – No licensing required.

Example:

A process server in California completes 10 serves in one year and must register with the county clerk to continue legally operating.

Tip: Understanding state laws is crucial—improper service may be challenged in court.

3. Legal Restrictions on Process Servers

Process servers must follow strict legal procedures. Violating these laws can result in penalties, invalidated serves, or legal consequences.

Common Legal Restrictions

  • Trespassing Laws – Process servers cannot enter locked or gated property without permission.
  • Time Restrictions – Some states prohibit service on Sundays, holidays, or late at night.
  • Restricted Locations – Service may not be allowed in places like courthouses, hospitals, or places of worship.

Example:

A process server in Texas tries to serve a defendant on a Sunday—a violation of state law. The serve is invalidated.

Warning: Ignoring legal restrictions can make a serve legally unenforceable.

4. Prohibited Actions & Ethical Violations

Certain actions are strictly illegal and can result in civil or criminal liability.

Unlawful Conduct for Process Servers

  • Impersonating Law Enforcement – Process servers cannot claim to be police officers or government agents.
  • Using Force or Threats – Intimidation, threats, or physical force are strictly prohibited.
  • Serving the Wrong Person IntentionallyFalse service of process can result in criminal fraud charges.
  • Falsifying Affidavits of Service – Lying about completing a serve is a crime punishable by fines or jail time.

Example:

A process server falsely claims they served a defendant, but security footage proves otherwise. The server faces legal action.

Reminder: Process servers must always act with integrity to avoid serious legal repercussions.

5. Alternative Service & Court-Ordered Exceptions

If a defendant cannot be served through traditional means, courts may allow alternative service methods.

Common Alternative Service Methods

  • Substituted Service – If personal service is impossible, documents may be left with a responsible adult at the defendant’s residence.
  • Service by Mail – Some states allow certified or registered mail as a valid service method.
  • Service by Publication – If a defendant cannot be found, courts may permit legal notices to be published in newspapers.
  • Electronic Service (E-Service) – Some courts allow service through email or social media in specific cases.

Example:

A defendant constantly moves to avoid service. The court allows the process server to serve them through social media messages.

Key Takeaway: Courts may grant creative solutions if a defendant is evading service.

6. Affidavit of Service: Legal Proof of Delivery

Every valid serve must be documented with an Affidavit of Service.

Affidavit of Service Requirements

  • Legally Binding Document – Confirms who was served, when, where, and how.
  • Notarization Requirements – Some states require affidavits to be signed before a notary public.
  • Evidence in Court – If a defendant claims they were never served, the affidavit provides proof.

Example:

A process server serves a defendant, but they later deny receiving the papers. The server presents a signed affidavit with GPS and photo evidence, proving the service was valid.

Pro Tip: Without an affidavit, a process serve may not hold up in court.

Summary: Key Laws & Regulations Governing Process Servers

State Licensing Some states require certification, exams, or background checks Serving documents without a license
Trespassing & Time Restrictions Defines where & when process servers can operate Entering a gated property or serving on a prohibited day

Final Thoughts: The Legal Boundaries of Process Serving

  • Process servers must follow strict laws to uphold due process.
  • Licensing and service methods vary by state—knowing local laws is essential.
  • Violating legal restrictions can lead to invalid service or legal action.
  • Proper documentation and integrity are critical to ensuring a serve is legally enforceable.

Excellent work. Right to the point with instructions what to send them and what their procedure was. Had my papers served right after the holiday weekend and a copy of the declaration was emailed to me and one was mailed led to the court. No surprises. I’d recommend them to others. Oh! Before I forget, what I like the most was that they answered the phone both times I called. This is rare nowadays.

Justin is the office staff member that did the coordination and John is the staff member that performed the actual document serving. Both super great individuals. Both professional. Both communicated extremely well. I received a follow up phone call from Justin (after the serve) to ensure I filed my paperwork with the court (given that this was a rush serve situation). I also received a confirmation call from John after the serve was completed, informing me how the serve was received.I would definitely use them again! You have to be careful what process servers you use. These guys are really good and professional. —Todd

Tried using a different process server prior to them to save some cash, but the other company struggled every step of the way from the very beginning. Decided to reach out to this company and they handled everything very smoothly and were able to get my person served quick. Communicated along the way, answered all of my questions and overall made me feel much more at ease over the whole situation. Will be using them more in the future and have already recommended them to anyone who needs a process server
