The Process Server (TPS) How to Become a Process Server: Qualifications & Requirements

Process servers play a vital role in the legal system. They ensure that individuals receive official court documents in compliance with due process laws.

While the job may seem simple, becoming a process server requires legal knowledge, specific qualifications, and in some states, formal certification.

So, what does it take to become a professional process server? Let’s break it down.

1. Basic Requirements to Become a Process Server

Each state has its own rules, but most process servers must meet a few fundamental qualifications.

  • Must Be 18 Years or Older – Many states require process servers to be legal adults.
  • Cannot Be a Party to the Case – Process servers must remain neutral and cannot serve documents in cases they are personally involved in.
  • Legal Residency – Some states require process servers to reside in the state where they work.
  • Clean Criminal Record – Many states conduct background checks to ensure process servers have no felony convictions.

Example:

A 19-year-old in Texas applies to become a process server.

They pass a background check, complete the required training, and obtain certification.

Why it matters: If you meet these basic criteria, you’re eligible to start the process.

2. State-Specific Licensing & Certification Requirements

Some states require process servers to obtain a license, certification, or court approval.

States That Require Licensing or Certification:

  • Arizona – Must pass a certification exam and register with the state.
  • California – Must register with the county clerk and provide a background check.
  • Florida – Some counties require process servers to be appointed by the court.
  • Nevada – Requires state licensing and a fingerprint-based background check.
  • Texas – Must complete a certified training course and register with the Judicial Branch Certification Commission (JBCC).
  • Washington – Process servers must register with the county auditor.

States That Do Not Require a License:

  • New York (Outside NYC) – No statewide licensing (NYC requires a license).
  • Illinois – No license needed for most process servers.
  • Kentucky, Iowa, Missouri, Maryland, North Carolina – No certification or licensing required.

Example:

A person in Arizona wants to become a process server.

They complete the required training, pass the exam, and register with the state.

Why it matters: Check your state’s laws before starting—every jurisdiction is different.

3. Process Server Training & Education

Even in states that don’t require certification, training can give you an edge.

  • State-Approved Training Programs – Some states require official courses covering legal procedures.
  • Private Training Courses – Offered by associations like NAPPS (National Association of Professional Process Servers).
  • On-the-Job Training – Some process servers learn by working under experienced professionals.

Example:

A Florida process server completes a NAPPS-approved training course.

Even though Florida doesn’t require a license, the certification helps them attract more clients.

Why it matters: Training makes you more skilled, professional, and legally compliant.

4. Legal Knowledge & Ethics Training

Understanding process serving laws is crucial to avoiding legal disputes.

  • Rules of Civil Procedure – Each state has strict guidelines on how legal documents must be served.
  • Prohibited Service Locations – Some states restrict service in churches, courthouses, or hospitals.
  • Time Restrictions – Some states prohibit service on Sundays or holidays.
  • Handling Evasive Defendants – Learn legal alternatives for when someone refuses to be served.

Example:

A Texas process server learns that they cannot serve legal papers on Sundays.

They reschedule their attempts to remain compliant with state laws.

Why it matters: Knowing the law prevents service challenges and legal issues.

5. Skip Tracing & Investigative Skills

Some defendants actively avoid being served. Skip tracing helps track them down.

  • Online Database Searches – Public records, credit headers, and address history help locate targets.
  • Social Media Investigation – Defendants often reveal their location online.
  • Stakeouts & Surveillance – Some process servers observe targets’ routines to find the best time to serve them.

Example:

A process server uses skip tracing software to find a defendant’s new address after they moved.

Why it matters: The better your investigative skills, the more successful your serves.

6. Technology & Digital Record-Keeping

Modern process servers rely on technology for accuracy and security.

  • GPS Tracking & Photo Proof – Logs time, date, and location to prevent disputes.
  • E-Filing & Digital Affidavits – Courts are increasingly accepting electronic service records.
  • Process Serving Apps – Tools like ServeManager automate tracking and affidavit generation.

Example:

A process server captures a timestamped photo of a successful serve, preventing legal challenges.

Why it matters: Tech-savvy process servers work faster, smarter, and more securely.

7. Personal Safety & Physical Fitness

Serving legal documents isn’t always safe—some recipients react aggressively.

  • Defensive Driving Skills – Knowing safe exit routes can be crucial.
  • Self-Defense Training – Helps process servers handle confrontational situations.
  • Body Cameras & Safety Equipment – Some process servers record interactions for security.

Example:

A process server delivers eviction papers and encounters an aggressive tenant.

They remain calm, record the serve, and leave safely.

Why it matters: Personal safety is just as important as serving the papers.

8. Business & Marketing Skills (For Independent Process Servers)

If you want to run your own process serving business, marketing is key.

  • Website & SEO Optimization – Rank for searches like “Process Server Near Me.”
  • Networking with Law Firms – Attorneys need process servers daily—build relationships.
  • Register on Legal Directories – Platforms like ServeNow and NAPPS connect you with clients.

Example:

A process server builds a website, runs Google ads, and partners with local law firms.

Within months, they have a steady stream of clients.

Why it matters: Success in process serving isn’t just about serving—it’s about getting hired.

Summary: Steps to Become a Process Server

1. Meet Basic Qualifications Be 18+, clean background, not a party to the case.

Excellent work. Right to the point with instructions what to send them and what their procedure was. Had my papers served right after the holiday weekend and a copy of the declaration was emailed to me and one was mailed led to the court. No surprises. I’d recommend them to others. Oh! Before I forget, what I like the most was that they answered the phone both times I called. This is rare nowadays.

Justin is the office staff member that did the coordination and John is the staff member that performed the actual document serving. Both super great individuals. Both professional. Both communicated extremely well. I received a follow up phone call from Justin (after the serve) to ensure I filed my paperwork with the court (given that this was a rush serve situation). I also received a confirmation call from John after the serve was completed, informing me how the serve was received.I would definitely use them again! You have to be careful what process servers you use. These guys are really good and professional. —Todd

Tried using a different process server prior to them to save some cash, but the other company struggled every step of the way from the very beginning. Decided to reach out to this company and they handled everything very smoothly and were able to get my person served quick. Communicated along the way, answered all of my questions and overall made me feel much more at ease over the whole situation. Will be using them more in the future and have already recommended them to anyone who needs a process server
