The Process Server (TPS) When They Won’t Take the Papers: How Process Servers Handle Refusals

Process serving isn’t always as simple as handing over documents and walking away.

Some recipients flat-out refuse to accept legal papers, thinking that rejecting service will make their case disappear.

But here’s the truth—avoiding service won’t stop legal proceedings.

So, how do process servers handle individuals who refuse to take legal documents?

Let’s break it down.

1. "You’ve Been Served" – Service Doesn’t Require a Signature

Many people mistakenly believe that if they don’t touch the papers, they weren’t legally served.

They’re wrong.

  • Personal Service is Complete the Moment It’s Delivered – If the process server identifies the recipient, states the purpose, and offers the papers, service is considered complete—even if the recipient refuses to take them.
  • Dropping the Papers at Their Feet – Many courts accept “drop service,” which means the server can place the documents at the recipient’s feet and walk away.
  • No Signature Required – In most cases, the recipient doesn’t need to sign anything to be considered legally served.

Example:

A defendant refuses to take the papers and walks away.
The process server drops them on the ground in front of them.

Legally, they’ve been served.

Why it matters: Not touching the papers doesn’t make them disappear.

2. Handling Physical Avoidance: When They Won’t Open the Door

What happens when the recipient refuses to answer the door or hides?

  • Multiple Attempts – Process servers make several attempts at different times (morning, evening, weekends).
  • Surveillance & Stakeouts – If someone is home but won’t answer, process servers observe their habits and serve them when they least expect it.
  • Serving Them in Public or at Work – If they won’t answer at home, they can be served at their job, gym, or even their favorite coffee shop.

Example:

A tenant dodges service at home, never answering the door.
The process server waits outside and serves them when they leave the apartment.

Why it matters: You can hide behind your door, but you can’t hide forever.

3. Substituted Service: When Direct Service Fails

If personal service isn’t possible, courts allow alternative methods.

  • Serving a Responsible Adult – In some states, documents can be left with a co-resident or employer if the recipient is unavailable.
  • Posting on the Door & Mailing – Some states allow documents to be taped to the recipient’s door and sent by certified mail.
  • Court-Ordered Alternative Service – If all else fails, the court may approve service via email, social media, or newspaper publication.

Example:

A defendant avoids all service attempts.
The court approves service by certified mail and posting on their front door.

Why it matters: Refusing service won’t stop the case—it only delays the inevitable.

4. Documenting the Refusal for Legal Proof

If a recipient refuses service, process servers gather evidence to prove they attempted it legally.

  • Affidavit of Service – A process server submits a sworn statement detailing the refusal.
  • Photo & Video Evidence – Some servers record the interaction or take timestamped photos as proof.
  • Witness Testimonies – If service occurs in public, bystanders can confirm the serve.

Example:

A defendant refuses to take the papers and slams the door.
The process server records a time-stamped affidavit stating what happened.

Why it matters: Courts trust documented proof over verbal denials.

5. Tracking Down the Evasive Recipient

Some people actively avoid being served, but skilled process servers use investigative tactics to locate them.

  • Skip Tracing – Using databases, phone records, and public records to find updated addresses.
  • Social Media Tracking – Many people post their location online without realizing it.
  • Following Their Routine – If they dodge service at home, process servers track their daily habits and serve them in public.

Example:

A process server notices a defendant posting gym selfies every morning.
They serve them as they leave the gym.

Why it matters: You can run, but you can’t hide from a determined process server.

6. Court Consequences for Evading Service

Avoiding service doesn’t help the defendant—it only makes things worse.

  • Default Judgment – If the defendant dodges service too long, the court may proceed without them and rule in the plaintiff’s favor.
  • Contempt of Court – Some judges issue sanctions or penalties for intentional evasion.
  • Court-Ordered Service Methods – If the recipient refuses personal service, the judge may allow alternative service methods.

Example:

A defendant ignores service attempts for months.
The court grants the plaintiff a default judgment, and the defendant loses the case automatically.

Why it matters: Ignoring service can cost someone their entire case.

Summary: How Process Servers Handle Service Refusals

Drop Service If the recipient refuses to take the papers, they can be dropped at their feet.
Multiple Attempts & Surveillance Servers make several attempts or track daily routines.
Serving in Public or at Work If they dodge service at home, they can be served at their job, gym, or a public place.
Substituted Service Some states allow service to co-residents or employers.
Court-Ordered Alternative Service If personal service fails, courts may approve mail, email, or social media service.
Legal Documentation of Refusal Process servers create a sworn affidavit to prove service attempts.
Consequences of Evading Service Courts may issue default judgments or sanctions.

Final Thoughts: No One Can “Dodge” the Law

  • Refusing legal papers doesn’t stop a case from moving forward.
  • Process servers have legal methods to complete service—even when recipients resist.
  • Courts recognize alternative service when someone refuses or evades personal service.
  • Skipping service can lead to a default judgment—meaning the recipient loses automatically.

Excellent work. Right to the point with instructions what to send them and what their procedure was. Had my papers served right after the holiday weekend and a copy of the declaration was emailed to me and one was mailed led to the court. No surprises. I’d recommend them to others. Oh! Before I forget, what I like the most was that they answered the phone both times I called. This is rare nowadays.

Justin is the office staff member that did the coordination and John is the staff member that performed the actual document serving. Both super great individuals. Both professional. Both communicated extremely well. I received a follow up phone call from Justin (after the serve) to ensure I filed my paperwork with the court (given that this was a rush serve situation). I also received a confirmation call from John after the serve was completed, informing me how the serve was received.I would definitely use them again! You have to be careful what process servers you use. These guys are really good and professional. —Todd

Tried using a different process server prior to them to save some cash, but the other company struggled every step of the way from the very beginning. Decided to reach out to this company and they handled everything very smoothly and were able to get my person served quick. Communicated along the way, answered all of my questions and overall made me feel much more at ease over the whole situation. Will be using them more in the future and have already recommended them to anyone who needs a process server
