The Process Server (TPS) Service of Process: The Foundation of Legal Due Process

Service of process is more than just delivering legal documents.

It’s a constitutional guarantee that ensures individuals have the right to defend themselves in court.

Without proper service, a lawsuit cannot proceed, and court rulings can be overturned due to lack of jurisdiction.

So, what is service of process, why is it important, and how does it work? Let’s break it down.

What is Service of Process?

Service of process is the legal procedure used to formally notify a party of their involvement in a lawsuit.

This ensures they are aware of the legal action and have the opportunity to respond.

  • Notifies the Defendant – Confirms that the person being sued, subpoenaed, or summoned is aware of the legal proceedings.
  • Preserves Due Process – Protects an individual’s right to be heard before a court rules against them.
  • Establishes Court Jurisdiction – Courts cannot issue rulings against individuals who have not been properly served.

Example:

A business is suing a former employee for breach of contract.
The process server delivers the summons, informing them that they must respond.

Why it matters: Without proper service, a lawsuit can be dismissed before it even begins.

Why Service of Process is Legally Required

Service of process is essential for upholding constitutional due process rights.

  • Fifth Amendment – No person shall be “deprived of life, liberty, or property, without due process of law.”
  • Fourteenth Amendment – Requires states to ensure individuals receive notice and an opportunity to be heard before a ruling is made.

Example:

A landlord files an eviction lawsuit against a tenant.
The tenant must be officially served before the court can order them to vacate.

Why it matters: Without proper notification, legal actions can be ruled unconstitutional.

3. Confirming Identity in Substituted Service Situations

Sometimes, direct service isn’t possible. When that happens, process servers follow legally approved alternatives.

How They Do It:

  • Serving a Responsible Adult – Some states allow delivery to another adult at the residence or workplace.
  • Employer or Coworker Confirmation – At workplaces, an employer may verify the defendant’s identity.
  • Court-Ordered Alternative Service – If the defendant is avoiding service, the court may allow posting at the residence, mail service, or publication.

Example:

A process server tries to serve someone who never answers the door.

After multiple failed attempts, the court approves substituted service with a co-resident who confirms the defendant lives there.

Legal procedures ensure even evasive individuals can be served properly.

What Happens if a Defendant Avoids Service?

Defendants sometimes try to dodge service, but courts have ways to handle this.

  • Multiple Attempts – Process servers use different times and locations to complete service.
  • Skip Tracing & Surveillance – Investigative methods help locate hard-to-find defendants.
  • Alternative Service – Courts may approve substituted service, mail service, or even service via social media.

Example:

A defendant moves to avoid being served.
The court allows service via certified mail and email instead.

Why it matters: Avoiding service won’t stop a lawsuit—it only delays the inevitable.

What Happens if Service of Process is Done Incorrectly?

If a defendant is not properly served, serious legal consequences can follow.

  • Case Dismissal – A lawsuit may be thrown out due to lack of jurisdiction.
  • Overturned Judgments – A defendant can challenge a ruling if they prove they were never served.
  • Legal Liability for the Process Server – Falsifying proof of service can lead to criminal charges and lawsuits.

Example:

A process server delivers papers to the wrong person.
The defendant was never properly notified and successfully appeals the court’s decision.

Why it matters: A lawsuit is only valid if service of process is legally executed.

Types of Legal Documents That Require Service of Process

  • Summons & Complaints – Notifies someone that they are being sued and must respond.
  • Subpoenas – Requires a person to appear in court or provide evidence.
  • Eviction Notices – Notifies tenants of lease violations or eviction proceedings.
  • Restraining Orders – Legally prohibits an individual from contacting another party.
  • Wage Garnishments & Court Orders – Enforces judgments and financial obligations.

Example:

A process server delivers a restraining order, ensuring it is legally enforceable.

Why it matters: Legal cases cannot proceed without proper service of process.

How Technology is Changing Service of Process

Modern tools make process serving more efficient and legally secure.

  • GPS Tracking & Photo Proof – Logs the exact time, date, and location to prevent disputes.
  • E-Filing & Digital Affidavits – Servers can file proof of service online instantly.
  • AI-Powered Skip Tracing – Helps track down evasive defendants.
  • Alternative Digital Service Methods – Some courts now allow service via email and social media.

Example:

A defendant claims they were never served.
The process server provides GPS data and timestamped photos as proof.

Why it matters: Technology eliminates disputes and increases efficiency.

Excellent work. Right to the point with instructions what to send them and what their procedure was. Had my papers served right after the holiday weekend and a copy of the declaration was emailed to me and one was mailed led to the court. No surprises. I’d recommend them to others. Oh! Before I forget, what I like the most was that they answered the phone both times I called. This is rare nowadays.

Justin is the office staff member that did the coordination and John is the staff member that performed the actual document serving. Both super great individuals. Both professional. Both communicated extremely well. I received a follow up phone call from Justin (after the serve) to ensure I filed my paperwork with the court (given that this was a rush serve situation). I also received a confirmation call from John after the serve was completed, informing me how the serve was received.I would definitely use them again! You have to be careful what process servers you use. These guys are really good and professional. —Todd

Tried using a different process server prior to them to save some cash, but the other company struggled every step of the way from the very beginning. Decided to reach out to this company and they handled everything very smoothly and were able to get my person served quick. Communicated along the way, answered all of my questions and overall made me feel much more at ease over the whole situation. Will be using them more in the future and have already recommended them to anyone who needs a process server
