The Process Server (TPS) Ensuring Accuracy: How Process Servers Confirm the Right Person is Served

Process serving isn’t just about handing over legal documents. It’s about making sure they are delivered to the right person, at the right time, in a legally valid manner.

If a serve is misdelivered or challenged, it can lead to delays, dismissals, or even overturned cases.

So, how do professional process servers guarantee that legal documents reach the correct recipient?

Let’s break it down.

1. Verifying Identity Before Service

Before handing over legal papers, process servers must confirm they’re dealing with the correct individual.

How They Do It:

  • Requesting Identification – A driver’s license, work ID, or other official documents.
  • Using Personal Identifiers – Verifying details like date of birth, home address, or employment.
  • Photo Confirmation – Matching the individual to a known image, if available.

Example:

A process server approaches someone and asks, “Are you John Doe?”

The individual hesitates but eventually confirms.

The process server cross-checks their date of birth before serving the documents.

No ID? No serve. Accuracy is everything.

2. Using GPS & Photo Documentation for Proof

Technology has made process serving more precise than ever.

How They Do It:

  • GPS-Logged Serve Attempts – Ensures the process server was at the correct location.
  • Timestamped Photos – Some take discreet photos of the individual or serve location for verification.
  • E-Signatures & Digital Receipts – Certain states allow electronic proof of receipt.

Example:

A defendant claims they were never served.

The process server presents a GPS log and timestamped photo, proving they were at the address at the time of service.

Technology makes service of process legally bulletproof.

3. Confirming Identity in Substituted Service Situations

Sometimes, direct service isn’t possible. When that happens, process servers follow legally approved alternatives.

How They Do It:

  • Serving a Responsible Adult – Some states allow delivery to another adult at the residence or workplace.
  • Employer or Coworker Confirmation – At workplaces, an employer may verify the defendant’s identity.
  • Court-Ordered Alternative Service – If the defendant is avoiding service, the court may allow posting at the residence, mail service, or publication.

Example:

A process server tries to serve someone who never answers the door.

After multiple failed attempts, the court approves substituted service with a co-resident who confirms the defendant lives there.

Legal procedures ensure even evasive individuals can be served properly.

4. Using Skip Tracing to Locate the Correct Person

Some defendants go off the grid to avoid being served. Skilled process servers use investigative tools to track them down.

How They Do It:

  • Database & Public Records Searches – Checking driver’s licenses, property records, and past addresses.
  • Social Media Clues – Many people reveal their locations or routines online.
  • Surveillance & Stakeouts – In some cases, process servers observe a location before making an approach.

Example:

A defendant moves frequently to avoid being served.

The process server tracks their new workplace using LinkedIn updates and serves them there.

Even the hardest-to-find defendants can’t outrun a skilled process server.

5. Filing an Affidavit of Service for Legal Proof

Once a serve is completed, process servers file an official Affidavit of Service to verify delivery.

How They Do It:

  • Notarized Statement of Service – Includes who was served, where, when, and how.
  • Court-Admissible Proof – Ensures the serve cannot be challenged.
  • Backup Evidence – If the defendant claims they weren’t served, the affidavit proves otherwise.

Example:

A defendant says, “I was never served.”

The process server presents a signed affidavit with GPS data and a timestamped photo.

The judge rules the service valid, and the case moves forward.

Proper documentation eliminates disputes.

Summary: How Process Servers Ensure the Right Person is Served

Identity Verification Confirms name, ID, or identifying details before service.
GPS & Photo Documentation Tracks location and provides timestamped evidence.
Substituted Service Verification Ensures documents are left with a legally responsible adult.
Skip Tracing & Investigative Tools Finds defendants who try to avoid being served.
Affidavit of Service Provides legally binding proof of successful service.

Final Thoughts: No One Can v”Dodge” the Law

  • A serve is only valid if it reaches the right person.
  • Process servers use identification checks, technology, and legal documentation to ensure accuracy.
  • GPS, photos, and affidavits provide court-admissible proof that service was completed.
  • Even evasive defendants can be tracked down using investigative tools.

Final Thought:

Process servers don’t just deliver documents—they deliver undeniable proof of legal service.

Excellent work. Right to the point with instructions what to send them and what their procedure was. Had my papers served right after the holiday weekend and a copy of the declaration was emailed to me and one was mailed led to the court. No surprises. I’d recommend them to others. Oh! Before I forget, what I like the most was that they answered the phone both times I called. This is rare nowadays.

Justin is the office staff member that did the coordination and John is the staff member that performed the actual document serving. Both super great individuals. Both professional. Both communicated extremely well. I received a follow up phone call from Justin (after the serve) to ensure I filed my paperwork with the court (given that this was a rush serve situation). I also received a confirmation call from John after the serve was completed, informing me how the serve was received.I would definitely use them again! You have to be careful what process servers you use. These guys are really good and professional. —Todd

Tried using a different process server prior to them to save some cash, but the other company struggled every step of the way from the very beginning. Decided to reach out to this company and they handled everything very smoothly and were able to get my person served quick. Communicated along the way, answered all of my questions and overall made me feel much more at ease over the whole situation. Will be using them more in the future and have already recommended them to anyone who needs a process server
