The Process Server (TPS) How Improper Service Can Destroy Legal Proceedings

Proper service of process is the foundation of due process. Without it, legal cases can collapse. If a process server makes a mistake, fails to follow legal guidelines, or falsifies service, it can have severe consequences for the case, the plaintiff, and the court.

Here’s how improper service can derail legal proceedings.

1. Case Dismissal: No Proper Service, No Case

If the defendant isn’t served correctly, the entire case may be dismissed.

  • Courts require legal notice before ruling against someone.

  • If the defendant proves improper service, the court may throw out the case entirely.

  • The plaintiff must restart the case, leading to delays, additional legal fees, and lost time.

A single mistake by a process server can erase months of legal work overnight.

2. Default Judgments Overturned

If a defendant doesn’t respond to a lawsuit, courts can enter a default judgment. However, if service was improper, that judgment can be overturned.

  • A defendant can file a motion to vacate a default judgment if they prove they were never legally served.

  • If the judge agrees, the case reopens, forcing the plaintiff to start over.

  • This is common in debt collection, evictions, and family court cases where improper service is often challenged.

Winning by default doesn’t matter if improper service takes it all away.

3. Expiration of the Statute of Limitations

Every legal claim has a deadline. If improper service delays the case, that deadline may pass.

  • If the statute of limitations expires, the plaintiff may lose the right to sue forever.

  • The defendant walks away without facing the lawsuit.

  • This is especially damaging in personal injury, debt collection, and civil litigation cases.

Bad service can permanently eliminate a plaintiff’s right to seek justice.

4. Wasted Legal Fees and Court Costs

Every failed service attempt costs money. Bad service can result in thousands of wasted dollars.

  • Plaintiffs must pay for new service attempts, increasing legal costs.

  • Attorneys may charge more if they need to refile cases due to improper service.

  • Courts may impose fines or require additional hearings to resolve disputes over service.

One mistake can turn an affordable case into an expensive disaster.

5. Delays That Give Defendants Time to Hide

If service is invalid, the defendant gains extra time to move, change jobs, or hide assets.

  • Business owners can dissolve companies to avoid lawsuits.

  • Debtors can move money offshore before proper service is completed.

  • Eviction cases can stall, allowing tenants to stay longer without paying rent.

A bad serve can give the defendant exactly what they need to escape justice.

6. Ethical and Legal Consequences for the Plaintiff

If improper service is intentional, the plaintiff can also face penalties.

  • Filing a lawsuit without proper service can be seen as legal abuse.

  • Courts may sanction plaintiffs who knowingly use improper service to gain an unfair advantage.

  • If a plaintiff submits a false affidavit of service, they could face perjury charges.

Cutting corners with service doesn’t just hurt the case—it can hurt the plaintiff, too.

8. Harm to the Plaintiff’s Credibility in Court

Judges expect plaintiffs to follow legal procedures. If they rely on improper service, they can lose credibility.

  • Judges may question the legitimacy of the entire case if service was faulty.

  • Defense attorneys will use improper service to argue that the lawsuit is flawed.

  • Even if the case continues, the plaintiff’s position may be weakened.

If the first step in a lawsuit is done wrong, it casts doubt on everything else.

7. Process Server Penalties and Fines

A process server who improperly serves documents can face legal action.

  • Lying about service can result in perjury charges.

  • Falsified service can lead to monetary fines and loss of certification.

  • Courts may blacklist process servers who repeatedly make errors.

A bad serve doesn’t just ruin a case—it can ruin a process server’s career.

Final Takeaway: Improper Service Can Destroy a Case

Legal service isn’t a formality—it’s the foundation of a valid case. If service is improper, everything that follows can collapse.

  • Case dismissal – No proper service, no lawsuit.

  • Default judgments overturned – A defendant can undo a case if service was bad.

  • Statute of limitations expired – A case may never be refiled.

  • Wasted legal fees – The plaintiff pays for every mistake.

  • Delays help defendants escape – Giving them more time to hide assets or avoid consequences.

  • Ethical and legal issues for plaintiffs – Courts may penalize those who abuse service rules.

  • Process servers face legal action – Bad servers can be fined or lose certification.

  • Plaintiff credibility suffers – Judges question cases built on faulty service.

Excellent work. Right to the point with instructions what to send them and what their procedure was. Had my papers served right after the holiday weekend and a copy of the declaration was emailed to me and one was mailed led to the court. No surprises. I’d recommend them to others. Oh! Before I forget, what I like the most was that they answered the phone both times I called. This is rare nowadays.

Justin is the office staff member that did the coordination and John is the staff member that performed the actual document serving. Both super great individuals. Both professional. Both communicated extremely well. I received a follow up phone call from Justin (after the serve) to ensure I filed my paperwork with the court (given that this was a rush serve situation). I also received a confirmation call from John after the serve was completed, informing me how the serve was received.I would definitely use them again! You have to be careful what process servers you use. These guys are really good and professional. —Todd

Tried using a different process server prior to them to save some cash, but the other company struggled every step of the way from the very beginning. Decided to reach out to this company and they handled everything very smoothly and were able to get my person served quick. Communicated along the way, answered all of my questions and overall made me feel much more at ease over the whole situation. Will be using them more in the future and have already recommended them to anyone who needs a process server
