Arizona · Attempts and timing
The number of visits in a service package is a scope decision. The legal question is whether the method used satisfies the rule or a court order, not whether a tally has been reached.
Arizona Civil Rule 4.1 does not prescribe three attempts, five attempts or another fixed number before a party may request alternative service. A quoted package may include a set number of visits, but buying those visits does not establish that a different service method is authorized.
Under Rule 4.1(d), personal delivery, delivery at the dwelling to a suitable co-resident, and delivery to an authorized agent are separate permitted methods. Dwelling service does not become available only after failed personal attempts. A coworker at a workplace does not qualify merely by being an adult.
Rule 4.1(k)(1) requires a showing that the methods in Rule 4.1(c) through (j) are impracticable. A party asks the court by motion, without notice to the person to be served. The court decides whether another method is appropriate; a server cannot approve it independently.
If alternative service is ordered, Rule 4.1(k)(2) also requires a reasonable effort at actual notice and mailing the summons, pleading and alternative-service order to the last-known business or residential address. Follow the order exactly, including any additional steps. Publication has separate requirements under Rule 4.1(l); it is not the automatic next step after a number of visits.
If the first visit finds no one home, ask whether another time, a verified workplace address or corrected unit information would help. A varied schedule is a practical recommendation, not a statewide minimum count. A dark house or parked car alone does not prove evasion.
Keep each visit distinct: date, time, full address, lawful access, who was encountered and what was actually observed. Separate observations from assumptions. These details help counsel explain why ordinary methods are impracticable instead of presenting a bare tally.
Confirm the visits included in the quote, extra-address and travel charges, when unsuccessful attempts will be reported and whether a factual diligence declaration is included. New addresses, additional visits and support for a court motion can have different scopes.
Do not wait for a package to run out before raising a deadline with counsel. The attempt count does not extend a service deadline and does not guarantee completion. Ask whether the documents are an initial summons, a subpoena, later papers or a special proceeding before assuming this rule applies.
