The Process Server (TPS) How New York’s Regulation of Process Servers Compares to Other States

When it comes to strict process server regulations, New York—especially New York City—stands out as one of the most heavily regulated jurisdictions in the United States.

While many states have basic licensing requirements, bonding, or legal penalties for misconduct, New York enforces additional rules, including:

  • GPS tracking for every service attempt

  • High bonding requirements

  • Felony penalties for misconduct

So how does New York’s process server regulation compare to other states? Let’s break it down.

1. Mandatory Licensing & Certification Requirements

New York

  • NYC requires all process servers to be licensed through the NYC Department of Consumer and Worker Protection (DCWP).

  • Background checks and fingerprinting are mandatory.

  • Process servers must renew their license every two years.

Other Strict States

  • California: Requires county-level registration for process servers serving more than 10 papers per year.

  • Florida: Requires court-approved certification with mandatory renewal in most judicial circuits.

  • Texas: Process servers must complete an approved training course and be certified by the Texas Supreme Court.

Less Strict States

  • Illinois (outside Cook County), Ohio, and many Southern states have little or no certification requirements for private process servers.

New York City is one of the few jurisdictions requiring city-level licensing in addition to state regulations.

2. Mandatory GPS Tracking & Service Logs

New York (NYC-specific)

  • Process servers MUST use GPS tracking to log every service attempt.

  • Logs must be kept for a minimum of seven years.

  • Failure to maintain logs can result in immediate fines or suspension.

Other Strict States

  • Texas: Requires detailed service documentation but does not mandate GPS tracking.

  • Arizona: Requires process servers to keep logs but does not require GPS tracking.

Less Strict States

  • Most states do not require GPS tracking for process servers, making New York’s requirement one of the strictest in the nation.

New York City is one of the only places in the U.S. that mandates GPS tracking for every service attempt.

3. Bonding & Financial Requirements

New York

  • $10,000 surety bond required for individual process servers.

  • $100,000 surety bond required for process-serving agencies.

Other Strict States

  • California: Requires a $2,000 bond for registered process servers.

  • Nevada: Requires a $10,000 bond for process servers.

Less Strict States

  • Texas, Florida, and Illinois do not require bonding for process servers.

  • Many Southern and Midwestern states have no financial requirements for process servers.

New York’s $100,000 bonding requirement for process-serving agencies is the highest in the U.S.

4. Severe Penalties for Violations

New York (NYC-specific)

  • Falsifying an affidavit of service is a felony (perjury) punishable by up to seven years in prison.

  • Fines of up to $10,000 for violating service regulations.

  • Engaging in "sewer service" (faking service attempts) can result in a permanent ban.

Other Strict States

  • Texas: Felony perjury charges for falsified affidavits (up to 10 years in prison).

  • Florida: Felony perjury for false service records and potential license suspension.

  • California: Case dismissal and fines for improper service, but penalties are less severe than in New York.

Less Strict States

  • Many states treat falsified service as a misdemeanor rather than a felony.

  • In Ohio or Missouri, penalties for improper service are generally limited to case dismissal or fines.

New York’s felony-level penalties for false affidavits make it one of the most aggressive jurisdictions in the U.S.

5. Strict Oversight & Complaint Process

New York

  • Process servers are heavily monitored by the NYC Department of Consumer and Worker Protection (DCWP).

  • Multiple complaints can lead to automatic suspension.

  • Regular audits ensure compliance with service tracking rules.

Other Strict States

  • Arizona: The Arizona Supreme Court directly oversees process server certification.

  • Florida: Some counties require sheriff oversight for private process servers.

  • Texas: The Supreme Court of Texas controls process server certification.

Less Strict States

  • Most states do not require regular oversight or audits for process servers.

  • In many states, complaints rarely lead to disqualification unless fraud is proven.

New York’s combination of audits, complaint tracking, and aggressive penalties makes it one of the most regulated states.

Excellent work. Right to the point with instructions what to send them and what their procedure was. Had my papers served right after the holiday weekend and a copy of the declaration was emailed to me and one was mailed led to the court. No surprises. I’d recommend them to others. Oh! Before I forget, what I like the most was that they answered the phone both times I called. This is rare nowadays.

Justin is the office staff member that did the coordination and John is the staff member that performed the actual document serving. Both super great individuals. Both professional. Both communicated extremely well. I received a follow up phone call from Justin (after the serve) to ensure I filed my paperwork with the court (given that this was a rush serve situation). I also received a confirmation call from John after the serve was completed, informing me how the serve was received.I would definitely use them again! You have to be careful what process servers you use. These guys are really good and professional. —Todd

Tried using a different process server prior to them to save some cash, but the other company struggled every step of the way from the very beginning. Decided to reach out to this company and they handled everything very smoothly and were able to get my person served quick. Communicated along the way, answered all of my questions and overall made me feel much more at ease over the whole situation. Will be using them more in the future and have already recommended them to anyone who needs a process server
