The Process Server (TPS) How State Laws Differ in Penalizing Process Servers for Improper Service

Every state has its own rules for process servers. But when a process server fails to comply with legal requirements, the penalties vary widely depending on where the violation occurs.

Some states impose heavy fines, while others pursue criminal charges, including felony perjury, fraud, or even jail time. Below is a breakdown of how different states penalize process servers for improper service—and what happens when they break the law.

1. New York: The Strictest Process Server Regulations

New York—especially New York City—has some of the toughest penalties for improper service.

  • Mandatory GPS tracking: If a process server falsifies a service attempt, GPS logs provide digital proof of fraud.

  • Fines for false affidavits: Penalties can reach $10,000+.

  • Perjury charges: Falsifying an affidavit can result in felony perjury and up to five years in prison.

  • License suspension or revocation: NYC process servers must be licensed by the Department of Consumer and Worker Protection (DCWP).

If a process server lies in New York, there’s digital evidence—and serious consequences.

2. California: Bonding & Background Checks Required

California enforces strict regulations, though penalties vary by county.

  • $2,000 bond requirement: If a process server violates the law, bond claims can be filed against them.

  • False affidavits = perjury penalties: Up to $10,000 in fines and potential jail time.

  • County-level license revocation: Los Angeles County has strict misconduct reviews.

  • Criminal penalties for impersonation: Pretending to be law enforcement is a felony offense.

California holds process servers financially and criminally accountable.

3. Florida: Sheriff Oversight & Annual Recertification

Florida enforces strict process serving rules at the county level.

  • Annual certification renewal: Process servers must recertify every year.

  • Sheriff oversight: County sheriffs regulate process servers and can revoke certification.

  • False service affidavits = felony perjury: Punishable by up to five years in prison.

  • Fines up to $5,000 for harassment or repeated violations.

In Florida, sheriffs strictly enforce compliance.

4. Texas: Statewide Certification & Harsh Criminal Penalties

Texas mandates statewide certification and enforces stiff penalties for misconduct.

  • Felony perjury for false affidavits: Punishable by up to ten years in prison.

  • License suspension for multiple violations.

  • Strict trespassing laws: Illegal entry while serving papers can lead to criminal charges.

  • Fines up to $10,000 for improper service or fraud.

Texas courts do not tolerate fraudulent process servers—one mistake can end a career.

5. Arizona: Supreme Court-Controlled Certification

Arizona’s Supreme Court oversees process server regulations.

  • Statewide certification revocation: If revoked, a process server is banned from working anywhere in Arizona.

  • False affidavits = felony perjury: Up to five years in prison.

  • Strict trespassing laws: Process servers must adhere to precise guidelines.

  • Contempt of court penalties: Judges may impose fines, suspensions, or jail time.

Arizona enforces lifetime bans for serious violations.

6. Illinois (Cook County): Court Approval & Criminal Penalties

Illinois has standard process serving laws, but Cook County (Chicago) enforces additional restrictions.

  • Court approval required: Process servers must be authorized by the Cook County Circuit Court.

  • Improper service penalties: Fines up to $5,000.

  • False service affidavits = felony perjury.

  • Sheriff involvement for evictions: Private process servers cannot serve eviction notices in Cook County.

Chicago enforces some of the strictest process serving rules in the country.

7. Washington D.C.: Federal-Level Process Service Penalties

Process servers in D.C. handle both state and federal-level cases, meaning penalties are severe.

  • Strict federal laws apply: False service in a federal case can lead to felony perjury charges (up to ten years in prison).

  • High-security service areas: Serving papers near federal buildings requires special permissions.

  • Fines up to $10,000 for misconduct.

D.C. process servers face federal-level legal risks.

State Comparison: Process Server Penalties by Jurisdiction

New York $10,000+ fines, felony perjury, GPS tracking
California $2,000 bond loss, jail time for perjury, county-level penalties
Florida Sheriff-controlled licensing, felony perjury, $5,000 fines
Texas Up to 10 years in prison for fraud, $10,000 fines, certification loss
Arizona Statewide certification revocation, contempt of court, felony perjury
Illinois (Cook County) Court-ordered penalties, $5,000 fines, eviction service restrictions
Washington D.C. Federal-level penalties, felony perjury, $10,000 fines

Final Takeaway: State Laws Vary, But Process Server Violations Are Costly

Every state penalizes process servers who fail to follow the law, but some states enforce stricter punishments than others.

  • New York and California – Heavy financial penalties and mandatory tracking.

  • Florida and Texas – Sheriff-controlled process serving and felony-level perjury laws.

  • Arizona and Illinois (Cook County) – Court-controlled certification and strict service requirements.

Excellent work. Right to the point with instructions what to send them and what their procedure was. Had my papers served right after the holiday weekend and a copy of the declaration was emailed to me and one was mailed led to the court. No surprises. I’d recommend them to others. Oh! Before I forget, what I like the most was that they answered the phone both times I called. This is rare nowadays.

Justin is the office staff member that did the coordination and John is the staff member that performed the actual document serving. Both super great individuals. Both professional. Both communicated extremely well. I received a follow up phone call from Justin (after the serve) to ensure I filed my paperwork with the court (given that this was a rush serve situation). I also received a confirmation call from John after the serve was completed, informing me how the serve was received.I would definitely use them again! You have to be careful what process servers you use. These guys are really good and professional. —Todd

Tried using a different process server prior to them to save some cash, but the other company struggled every step of the way from the very beginning. Decided to reach out to this company and they handled everything very smoothly and were able to get my person served quick. Communicated along the way, answered all of my questions and overall made me feel much more at ease over the whole situation. Will be using them more in the future and have already recommended them to anyone who needs a process server
