Serve Eviction Notice in Nevada

Nevada eviction notices are governed by NRS Chapter 40. The notice type, timing, and service method must be precisely matched to the violation — or the entire eviction is subject to dismissal at the justice court summary eviction hearing. Licensed servers deployed immediately upon assignment.

Nevada Eviction Notice Types

3-Day Notice to Pay or Quit

Issued for nonpayment of rent. Tenant has 3 judicial days to pay the full amount owed or vacate. Service must be documented — if the tenant ignores it, the landlord files a summary eviction complaint at the justice court.

3-Day Notice to Perform or Quit

Issued for lease violations other than nonpayment. Tenant has 3 judicial days to remedy the violation or vacate. Specific violation must be identified in the notice.

5-Day Notice for Unlawful Detainer

Issued when a tenant holds over after lease expiration without landlord consent. Nevada NRS 40.250 — 5-day notice before filing unlawful detainer action.

7-Day Notice to Quit (No Cause)

Week-to-week tenancies. Landlord can terminate with 7 days notice. No cure period — tenant must vacate.

30-Day Notice to Quit (No Cause)

Month-to-month tenancies. Landlord must give 30 days notice to terminate tenancy without cause. Must be personally served or substitute-served and mailed.

Service Methods Under NRS Chapter 40

1.

Personal Service

Physically handing the notice to the tenant. Gold standard — uncontestable if documented correctly with date, time, location, and server certification.

2.

Substitute Service

Leaving with a person of suitable age and discretion at the premises, plus mailing a copy to the address. Both steps must be documented separately.

3.

Posting & Mailing

If no person available: conspicuously posting at the premises plus mailing to the tenant. Only used after documented personal and substitute service attempts.
