Nevada garnishment is a post-judgment enforcement tool — after a court has issued a money judgment, garnishment compels the judgment debtor's employer or bank to withhold and remit funds. Service must be executed on the correct entity with strict NRS compliance or the garnishment fails.
After a money judgment, a writ of garnishment is served on the judgment debtor's employer. The employer withholds a portion of wages each pay period per NRS 31.295. Nevada limits garnishment to 25% of disposable earnings or the amount exceeding 50x federal minimum wage — whichever is less.
Served on the judgment debtor's financial institution. The bank freezes and remits funds up to the judgment amount. Must be served on the correct branch or registered agent per NRS Chapter 31.
Can reach other third-party assets owed to the debtor — accounts receivable, rents, commissions. Served on the third party holding the asset.
Confirm Judgment Exists
Garnishment is post-judgment only. A valid Nevada court money judgment must exist before garnishment proceedings begin.
