Justice of the Peace in Arizona
A Justice of the Peace (JP) is a judicial officer in lower courts appointed or elected to maintain peace and handle specific judicial matters. In Arizona, JPs play a crucial role in the judicial system by handling various cases and administrative duties. JPs have jurisdiction similar to that of a municipal magistrate and handle traffic and misdemeanor cases, restraining orders, county ordinances, civil lawsuits, small claims, and eviction cases. JPs are elected in partisan elections for four-year terms from specific districts called precincts.

Traffic and Misdemeanor Cases
JPs handle cases that involve traffic violations and misdemeanors within their jurisdiction.
Restraining Orders
They can issue restraining orders to protect individuals from harm.
County Ordinances
JPs oversee cases involving ordinances enacted by the board of supervisors that apply to unincorporated areas.
Civil Lawsuits
They hear civil lawsuits with claims up to $10,000.
Small Claims
JPs handle small claims cases up to $2,500 or up to $3,500 in Maricopa County.
Evictions
They issue writs of restitution for evictions after a successful detainer action by a landlord.
Marriages and Oaths
JPs perform marriages, administer oaths, and adhere to the code of judicial conduct.
Qualifications and Training
Arizona law does not require Justices of the Peace to be lawyers. Many JPs are not legally trained, although the Arizona Supreme Court requires all to complete a course at the Arizona Judicial College. This ensures they are equipped with the necessary knowledge and skills to perform their duties effectively.
