The Process Server (TPS) Which State Has the Most Stringent Regulations for Process Servers?

Not all states have the same requirements for process servers. While some states have minimal oversight, others enforce strict licensing, tracking, and compliance laws. A process server operating in the wrong jurisdiction without proper adherence to the rules could face fines, legal consequences, or even jail time.

So, which state has the toughest process serving regulations in the U.S.?

New York: The Toughest State for Process Servers

Strict Licensing & Bonding Requirements

New York—especially New York City—has the most rigorous process server regulations in the country.

  • Mandatory licensing – Process servers must be licensed through the NYC Department of Consumer and Worker Protection (DCWP).

  • Background checks required – Extensive vetting is required before approval.

  • Bonding requirements – Individual process servers must carry a $10,000 surety bond, while agencies must secure a $100,000 bond.

Mandatory GPS Tracking & Service Logs

  • NYC process servers must use GPS tracking to log every service attempt.

  • All service records must be maintained for seven years.

  • Failing to submit detailed logbooks can lead to fines and license suspension.

Severe Penalties for Violations

  • Falsifying an affidavit of service is perjury, a felony offense punishable by up to 7 years in prison.

  • "Sewer service" (faking service attempts) leads to immediate disqualification.

  • Fines of up to $10,000 for violations, with repeat offenders losing their license permanently.

In New York, process servers are under constant scrutiny—one mistake can end their career.

How New York Compares to Other Strict States

New York ✅ Yes (NYC) ✅ Yes ($10,000-$100,000) ✅ Yes ✅ Felony perjury, $10K fines
California ✅ Yes (County Level) ✅ Yes ($2,000) ❌ No ✅ Case dismissal, fines
Florida ✅ Yes (Judicial Circuits) ❌ No ❌ No ✅ Felony perjury
Texas ✅ Yes (State-Level Certification) ❌ No ❌ No ✅ Felony perjury, jail
Arizona ✅ Yes (Supreme Court Certified) ❌ No ❌ No ✅ Court-imposed sanctions
Illinois (Cook County) ✅ Yes (Court Approval) ❌ No ❌ No ✅ Court bans for misconduct
Washington D.C. ✅ Yes (Federal Rules Apply) ❌ No ❌ No ✅ Federal penalties

While states like California, Florida, and Texas have strict regulations, New York’s combination of mandatory GPS tracking, severe bonding requirements, and felony-level penalties make it the hardest state for process servers.

Final Takeaway: New York Is the Most Difficult State for Process Servers

New York enforces process serving laws more aggressively than any other state.

  • Mandatory GPS tracking and service logs – NYC servers are monitored 24/7.

  • Highest bonding requirements in the U.S. – Up to $100,000 required.

  • Severe criminal penalties for violations – Felony perjury, license revocation, and up to 7 years in prison.

  • Strictest service documentation rules – Logs must be kept for seven years.

Excellent work. Right to the point with instructions what to send them and what their procedure was. Had my papers served right after the holiday weekend and a copy of the declaration was emailed to me and one was mailed led to the court. No surprises. I’d recommend them to others. Oh! Before I forget, what I like the most was that they answered the phone both times I called. This is rare nowadays.

Justin is the office staff member that did the coordination and John is the staff member that performed the actual document serving. Both super great individuals. Both professional. Both communicated extremely well. I received a follow up phone call from Justin (after the serve) to ensure I filed my paperwork with the court (given that this was a rush serve situation). I also received a confirmation call from John after the serve was completed, informing me how the serve was received.I would definitely use them again! You have to be careful what process servers you use. These guys are really good and professional. —Todd

Tried using a different process server prior to them to save some cash, but the other company struggled every step of the way from the very beginning. Decided to reach out to this company and they handled everything very smoothly and were able to get my person served quick. Communicated along the way, answered all of my questions and overall made me feel much more at ease over the whole situation. Will be using them more in the future and have already recommended them to anyone who needs a process server
