Who Can Serve Papers in Arizona?

Arizona Rule of Civil Procedure 4.1 sets out exactly who is authorized to serve legal process. Not everyone qualifies.

Authorized

Qualified to Serve

  • Licensed Process Servers

The most reliable option. Licensed professionals who know Arizona rules, document diligence properly, and produce court-defensible affidavits.

  • Any Adult Non-Party

Any person 18 years or older who is NOT a party to the case may serve process in Arizona. This includes friends, employees, or anyone with no stake in the outcome.

  • Sheriff or Marshal

County sheriffs and court marshals may serve process. Common in criminal matters and for defendants in custody.

  • Arizona Attorney

Attorneys licensed in Arizona may serve process personally in limited circumstances, though this is uncommon in practice.

Disqualified

Not Qualified to Serve

  • Parties to the Case

The plaintiff, defendant, or anyone with a direct legal interest cannot serve process. This voids service regardless of how correctly it was executed.

  • Minors Under 18

Anyone under 18 years old cannot serve process in Arizona, even if otherwise neutral to the case.

Rationale

Why Use a Licensed Process Server

While Arizona technically allows any adult non-party to serve, using a licensed professional matters because:

  • They know substitute service rules cold
  • Their affidavits are formatted for court acceptance
  • They document diligence in ways that survive motions to quash
  • They carry professional liability if something goes wrong
  • Judges and opposing counsel take professional service seriously
