Once legal papers are served in Arizona, a specific sequence of legal events is triggered. Understanding what comes next is critical for both plaintiffs and defendants.
Sequence
1. Proof of Service Filed
The process server completes a sworn affidavit of service (proof of service) and files it with the court. This document establishes that service was completed properly.
2. Response Deadline Begins
Once served, the defendant has 20 days to file a written response in Arizona Superior Court (shorter periods may apply in justice courts). The clock starts the day after service.
3. Defendant Responds or Defaults
The defendant must file a formal answer, motion to dismiss, or other responsive pleading. Failure to respond can result in a default judgment being entered against them.
4. Case Proceeds or Default Entered
If the defendant responds, the case proceeds through the court process. If no response is filed, the plaintiff can apply for a default judgment after the deadline passes.
5. Default Judgment Consequences
A default judgment in Arizona gives the plaintiff the right to collect the full amount claimed, garnish wages, levy bank accounts, or place liens on property.
