In Arizona, a Petition for Dissolution of Marriage must be properly served on the other spouse before the divorce can proceed. The petitioner cannot serve the papers themselves.
The Petition for Dissolution of Marriage, Summons, and any preliminary injunction or temporary order must all be served together.
The other spouse (respondent) must be personally served. If they cannot be found after diligent search, alternative service may be requested.
The respondent has 20 days to file a Response (or 30 days if served outside Arizona). Service starts the clock.
The process server's affidavit of service must be filed with the Arizona Superior Court before the case can move forward.
