Houston, Texas

Process server in Houston

Houston is the largest city in Texas and most of its addresses sit in Harris County — but the city’s edges cross into Fort Bend and Montgomery, and the citation’s court follows the address, not the postmark.

Jurisdiction

What Houston service requires

Houston service is Texas service: TRCP 103, 106, and 107 apply, with the court’s own expectations layered on top.

Who may serve. A sheriff, constable, or any person at least eighteen who is not a party and has no interest in the case. Substitute methods require the court’s authorization and a diligence affidavit.

Where the case runs. Houston cases are filed in Harris County district courts, county civil courts at law, or a justice of the peace precinct. The precinct follows the defendant’s address, and some Houston addresses fall to a precinct court outside the downtown core.

Return. The return states when, how, and to whom citation was delivered. For entity service, the capacity of the person served is stated so the court can see authority.

County edges matter

A small part of Houston extends into Fort Bend and Montgomery counties. If the address falls outside Harris, the filing court and the constable’s office change with it.

Execution

How a Houston assignment runs

Attempts are grouped by geography and by building type so a day of work is not lost to the freeway.

  1. Intake

Case details, defendant information, service address, and documents are captured in one request.

  2. Jurisdiction routing

The assignment is matched to the venue, county, and precinct responsible for that address.

  3. Attempts & logs

Each attempt is recorded: date, time, address description, access conditions, and contact outcome.

  4. Escalation

Where personal service fails, substitute service or a diligence record for alternative service is prepared.

  5. Proof delivered

When service is completed, a signed, sworn affidavit of service documents the applicable recipient, date, time, location and method of service. When service is unsuccessful, a signed, sworn affidavit of non-service or due diligence documents the attempts, circumstances, findings and unsuccessful outcome. Both are executed under penalty of perjury and prepared in accordance with the applicable jurisdiction's execution and filing requirements.

Local considerations

What decides a Houston attempt

Access, identity, and timing are what separate a completed service from a documented attempt.

Tunnel and lobby systems

Downtown buildings connect through tunnels and private security desks. Access is planned per building, and refusals are recorded.

Medical Center complexity

Hospital and research campuses require visitor screening and can route delivery to a mailroom that will not accept documents for an individual.

Gated master-planned communities

Guard gates in the western and northern suburbs decide whether an attempt reaches a door. Gate policy and outcome are recorded each time.

Registered agent concentration

Entity service is directed to the agent of record on the Texas Secretary of State filing, and the person’s capacity is stated in the return.

Houston is not a single operational jurisdiction. It is the fourth-largest city in the United States — 2.3 million residents across 669 square miles — the primary service jurisdiction for the broader Harris County metro, and one of the most operationally complex urban service environments in Texas.

Houston spans dense urban core districts, inner loop residential neighborhoods, industrial zones near the port, suburban corridors, and sprawling commercial districts — each with distinct service access conditions, building types, and address density patterns.

Houston connects upward to Harris County coverage and downward to submarket-level geographic nodes that define specific service conditions at the neighborhood level.

Local practice

Houston Is Not Uniform

Downtown Houston and the Galleria/Uptown corridor are high-rise, controlled-access environments where standard residential approach protocols do not apply. The Energy Corridor is an industrial-adjacent commercial zone with employer-managed access. Sharpstown and Spring Branch are dense mixed residential and commercial neighborhoods with their own access and routing conditions.

Service difficulty in Houston does not correlate with distance from downtown. A gated residential address in Memorial may be harder to access than an open commercial address in Greenspoint. An apartment complex in Midtown may have more access barriers than an unincorporated address in far northwest Houston.

Houston also spans multiple Harris County Justice of the Peace precincts. Service for small claims and eviction matters must be routed to the correct precinct based on defendant address — and Houston's size means address-to-precinct mapping cannot be assumed.
