County practice

Three court systems in one county

Harris County filings split by amount in controversy and by case type, not by geography.

District courts. Felony and major civil matters, including most family and large-dollar civil cases, are filed in the Harris County district courts downtown. Returns are prepared for the district clerk’s requirements.

County civil courts at law. Civil cases within the statutory county-court limit are filed in the county civil courts at law. Eviction appeals and smaller civil matters move through this structure.

Justice courts. Small claims, evictions, and Class C matters are filed by justice of the peace precinct. The precinct follows the address, so an assignment can be in Harris County and still land in a specific precinct court.

Precinct follows the address

Houston addresses are not split evenly across the justice precincts. The defendant’s address determines the precinct, and the precinct determines the court the proof is prepared for.

Execution

How a Harris County assignment runs

Downtown towers, medical center buildings, and unincorporated subdivisions each need a different approach.

Downtown and Medical Center access

Tower lobbies, tenant-only elevators, and hospital campuses add checkpoints. Attempts are scheduled when the person is likely present rather than when the building is easiest to enter.

Unincorporated Harris County

Much of the county is unincorporated, so a Houston-area address may belong to no city at all. That changes access conditions, not the court structure.

Registered agents

Houston holds a large concentration of registered agents. Entity service is directed to the agent of record and the capacity of the person served is stated in the return.

Distance inside one county

Harris County is large enough that two addresses in the same county can be an hour apart. Attempt routing is sequenced by geography.

Harris County, Texas

Harris County is the most populous county in Texas and the third most populous in the United States — 4.8 million residents across 1,777 square miles. It is the primary service jurisdiction for the Houston metro and anchors one of the most operationally complex legal service environments in the country.

Within Harris County sits Houston proper — 2.3 million residents, 669 square miles — alongside incorporated cities including Pasadena, Baytown, Missouri City, and dozens of unincorporated communities. Each has its own address profile, access density, and proximity to specific court precincts.

Harris County connects upward to the Texas state service network and downward to city-level and submarket coverage across the Houston area.

Local practice

Harris County Is Not Flat

Harris County contains some of the most access-dense service environments in Texas and some of the most remote unincorporated addresses in the Houston metro. Downtown Houston high-rises and controlled-access residential towers are not the same service environment as an unincorporated address in northwest Harris County — they require different routing, different access protocols, and different attempt schedules.

The county's 16 Justice of the Peace precincts create venue fragmentation that matters legally. Filing a small claims or eviction action in the wrong precinct creates a venue defect. The correct precinct is determined by the defendant's address — not the plaintiff's location.

Industrial corridors near the Port of Houston, the Energy Corridor, and major refinery zones introduce access restrictions not present in residential or commercial districts. Service at industrial addresses requires advance coordination, not standard residential approach.
