How to Serve Papers in Phoenix

Legal document delivery methods, procedures, and proof of service requirements.

Methods

Service Methods

  • Personal Service

Direct hand-delivery to the defendant. Strongest method, accepted everywhere.

  • Substitute Service

Delivery to another person at defendant's residence or workplace. Arizona Rules of Civil Procedure § 4.1(d).

  • Registered Agent Service

For corporations, LLCs, and other entities. Serve through registered agent of record.

  • Certified Mail

Mailed with signature required. Limited jurisdictions, venue-specific restrictions.

  • Service by Publication

Last resort for evasive defendants. Requires heavy diligence documentation.

Proof

Proof of Service

After service, you must file an affidavit proving service to the court.

The affidavit must document:

  • Who was served and when
  • Where service occurred
  • How service was accomplished
  • Any prior diligence (failed attempts)

Bad affidavits get courts to reject service. Weak proof restarts deadlines.

Phoenix Court Culture

Phoenix Superior Court expects thorough diligence documentation and precise affidavit language. Weak service execution triggers motions to quash.
